1. Introduction and Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Libertas Care Services, LLC., and its affiliated developers, officers, employees, agents, and licensors (collectively, "SymWellness", "Libertas Care Services", "we", "us", or "our") governing your access to and use of the SymWellness mobile and web application (the "App"). SymWellness is a product of Libertas Care Services, LLC., a limited liability company organized under the laws of the State of Idaho.
By creating an account, downloading, installing, accessing, or using the App in any manner, you confirm that you are at least 18 years of age (or the legal age of majority in your jurisdiction), that you have the legal capacity to enter into these Terms, and that you accept these Terms in full without modification.
2. Nature of the App
SymWellness is a personal health and wellness application designed as a digital notebook, reminder, and AI-assisted wellness tool. Features include:
- Personal notes tracker for logging supplement and vitamin intake
- Medication reminders — simple alerts configured by the user
- Ingredient lookup — general educational information about supplement contents
- Wellness logging — a personal journal for symptoms, moods, and health observations
- General lifestyle suggestions — non-clinical informational prompts
- AI-powered wellness feedback via OpenRouter AI (subject to your consent)
- Calorie and meal scanning via OpenRouter AI (subject to your consent)
IMPORTANT: SymWellness is strictly a note-taking, reminder, and wellness tool. It does NOT analyze, interpret, or act upon your health data in any clinical capacity. All suggestions and AI-generated outputs are informational only and are NOT tailored to your individual medical history or condition.

3. SymWellness Is Not a Medical Device
SymWellness is expressly NOT a medical device, diagnostic tool, treatment platform, or clinical application of any kind.
3.1 No FDA Classification or Regulatory Approval
SymWellness has not been submitted to, reviewed by, or approved by the FDA or any equivalent regulatory body as a medical device or SaMD. SymWellness makes no claims of clinical efficacy, therapeutic benefit, or diagnostic capability.
3.2 No Clinical Processing of User Data
SymWellness does not process user-entered health information for clinical purposes. Information entered — including meal scans, supplement logs, and wellness notes — is used solely to provide features you request and for which you have provided consent.
3.3 Suggestions and AI Output Are Non-Clinical
AI-generated wellness feedback, calorie estimates, and meal composition analysis are general informational outputs only and should never be treated as professional medical or nutritional guidance.
3.4 Reminders Are User-Configured Tools Only
Medication and supplement reminders are notification tools configured by the user. SymWellness does not verify or advise on medication schedules, dosages, or combinations.

4. No Medical Advice — Critical Disclaimer
4.1 No Doctor-Patient Relationship
Use of the App does not create a healthcare provider relationship between you and SymWellness, Libertas Care Services, LLC., its developers, or any third party.
4.2 AI Output Is Not Medical or Nutritional Guidance
Any suggestions, calorie estimates, meal composition data, or wellness feedback are general informational outputs only. Consult a qualified healthcare provider or registered dietitian before decisions about your health, diet, medications, or supplements.
4.3 Ingredient and Nutritional Information
Nutritional data from meal scans is sourced from AI analysis and public references. SymWellness makes no guarantee of accuracy. Do not rely on this data for medical, allergy, dietary, or clinical decision-making.
5. AI-Powered Features and Third-Party AI Services
Apple App Store compliance: Guidelines 5.1.1(i) and 5.1.2(i) regarding third-party AI data sharing disclosures.
5.1 Use of Third-Party AI Services
AI-powered features are processed through OpenRouter AI (OpenRouter, Inc., openrouter.ai), which routes data to an appropriate AI language model to generate responses for features you use.
5.2 What Data Is Sent to OpenRouter AI
Wellness & Mood: wellness notes, mood entries, weight/progress entries, supplement names and dosages you entered.
Calorie & Meal Scan: food photos, meal descriptions, AI-generated composition and calorie estimates.
Never sent: name, email, payment information, device identifiers, location, or account credentials.
5.3 Your Consent for AI Data Transmission
Before first transmission, the App displays a consent screen. You must actively agree. You may withdraw consent in Settings → Legal & Privacy → AI Data Sharing.
5.4–5.5 OpenRouter & AI Liability
See openrouter.ai/privacy. AI outputs are informational only; SymWellness does not guarantee accuracy and is not responsible for decisions you make based on AI-generated content.
Limitation of liability
6. Limitation of Liability and Disclaimer of Warranties
THE APP IS PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYMWELLNESS AND LIBERTAS CARE SERVICES, LLC. SHALL NOT BE LIABLE FOR HEALTH-RELATED, AI-RELATED, OR CONSEQUENTIAL DAMAGES.
Liability cap: total cumulative liability shall not exceed the lesser of (A) amounts you paid in the twelve (12) months before the claim, or (B) USD $50.00.
7. User Responsibilities and Acknowledgements
- Do not use the App as a substitute for professional medical, nutritional, or dietary advice
- Seek prompt medical attention for emergencies
- Take personal responsibility for health and dietary decisions made with the App
- Calorie estimates are approximations only
- Consent to AI data sharing (Section 5) before using AI features
8. Indemnification
You agree to indemnify SymWellness and Libertas Care Services, LLC. for claims arising from your use of the App, violation of these Terms, or health or dietary decisions based on App content or AI outputs.

Health-related information is handled per our Privacy Policy. AI features use OpenRouter subject to explicit consent. SymWellness uses AES-256 encryption and reasonable safeguards.
11–13. Intellectual Property, Changes, Termination
App content is owned by Libertas Care Services, LLC. or licensors. We may modify the App or these Terms. We may suspend or terminate access for violations.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Idaho, USA. Disputes are resolved by binding individual arbitration in Idaho. Class actions are waived. Claims must be filed within one (1) year.
15–16. Entire Agreement & Contact
These Terms and the Privacy Policy are the entire agreement between you and Libertas Care Services, LLC..
